All products offered for sale are original works specifically designed by and for Timbuktu Research and Design and are considered exclusive products. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any portion of the Site’s content or product designs without our prior written consent. The “Timbuktu Research and Design” name and logo are our trademarks.

Rule 3: User Account Responsibilities
If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must be at least the age of majority in your state or province of residence to use this Site. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

Rule 5: Product Information, Pricing & Modifications
We strive to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your monitor’s display will be accurate. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We are not responsible for typographical errors regarding price or any other matter.

Rule 6: Terms of Sale & Payment
By ordering a product, you agree that you are responsible for paying the full price, including any applicable shipping costs and taxes. You agree to provide current, complete, and accurate purchase and account information for all purchases made. We use third-party payment processors (e.g., Stripe, PayPal), and you agree to their terms. We reserve the right to correct any errors in pricing, even after an order has been confirmed.

Rule 7: Shipping & Delivery Policy
Physical products are shipped worldwide via DHL from the Republic of Congo. Packages are generally dispatched within 2 business days after payment is received. Shipping costs include handling and packing fees. The customer is solely responsible for any and all customs duties, import taxes, and fees levied by the destination country. Title and risk of loss for all products ordered pass to you upon our delivery of the items to the carrier (DHL).

Rule 8: Digital Product Delivery
Digital products (e.g., files provided via download link or sent as a .PDF to your provided email) are delivered immediately upon successful payment verification. Due to the nature of digital products, all sales are final and non-refundable.

Rule 9: Returns, Refunds, and Cancellations for Physical Goods
Our Return Policy for physical goods is incorporated into these Terms. You may return eligible physical items within [e.g., 14 or 30] days of delivery. The item must be unused and in its original packaging. The customer is responsible for return shipping costs. Refunds will be processed to the original method of payment once the returned item is received and inspected.

IN NO CASE SHALL TIMBUKTU RESEARCH AND DESIGN, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED USING THE SITE.

Rule 11: Indemnification
You agree to indemnify, defend, and hold harmless Timbuktu Research and Design and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.

Rule 12: Governing Law & Dispute Resolution
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of Congo. Any dispute arising from your use of the Site or purchase of our products shall be subject to the exclusive jurisdiction of the courts of the Republic of Congo. We retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

Rule 13: Severability
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such a determination shall not affect the validity and enforceability of any other remaining provisions.
